The Napa Valley Farmworker Foundation ("FWF" or "Foundation") values the privacy of its donors and others who visit its Website, attend its events, and interact with the Foundation online or in person. This Privacy Policy applies to the Foundation’s practices regarding the collection, use, and disclosure of personal information collected both offline and online, including via its website located at https://www.farmworkerfoundation.org (the "Website"), by email, social media, marketing communications, or other methods. It is intended to apply to donors as well as others.

User Consent

Users should read this entire Privacy Policy before submitting information to the Foundation or using the Website. Whenever users submit information via the Website or otherwise to the Foundation, whether online or offline, they consent to the collection, use, and disclosure of that information in accordance with this Privacy Policy.

How the Foundation Collects Personal Information

The Foundation collects personal information in the following ways:

  1. Direct submissions from users when they voluntarily submit information to the Foundation.

Data Collection from Third-Party Sources

All personal information may be used for the purposes stated in this Privacy Policy. The Foundation will retain personal information for the period necessary to fulfill that purpose and as otherwise needed to comply with applicable law and internal policies.

Information Collected

When ordering or registering on the Website, as appropriate, users may be asked to enter their name, email address, mailing address, or phone number. Users may, however, visit the site anonymously.

The Foundation collects information from users when they register on the Website, place an order, subscribe to the newsletter, make a donation, respond to a survey, or fill out a form. This information includes, but is not limited to, contact information, user information, donation history, and member preferences.

When users participate in telephone or video calls, the Foundation may record their voice or image for educational or training purposes, but it does not store these recordings or information. When users enter the Foundation’s premises, their image may be captured on video surveillance, and certain health information may be collected for safety and security purposes. This information is not stored after the visit.

For in-person events, the Foundation may record and/or photograph events for promoting services and providing educational resources. Copyright and any intellectual property in photographs or recordings belong to the Foundation. By attending, users consent to filming, photography, and live streaming, allowing the Foundation to reproduce and publish users’ words or likeness in any related publication or for publicizing the Foundation’s services and those of its partners. Photos and recordings containing personal data will be securely handled in line with data protection laws. When users visit the Website, certain information such as IP address and time of visit may be collected. This site, like many others, records basic information about visits to the Website.

Use of User Information

Information collected from users may be used in one of the following ways:

  • To personalize the user experience (user information helps the Foundation respond to individual needs).

  • To improve the Website (the Foundation continually improves Website offerings based on feedback).

The Foundation takes appropriate security measures to protect personal information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. It offers the use of a secure server. Sensitive information is transmitted via Secure Socket Layer (SSL) technology, encrypted, and accessible only to those with special access rights.

After a transaction, user private information (credit cards, social security numbers, financials, etc.) is not stored on the Foundation’s servers.

Cookies and Tracking Technologies

As users navigate the Website, some information can be passively collected using various technologies, such as cookies, web beacons, and navigational data collection (e.g., clickstream, log files, server logs). The user’s Internet browser automatically transmits information, such as the URL of the last website visited and the IP address. These technologies help the Foundation track user interactions, including pages viewed and links clicked.

Disclosure to Outside Parties

Non-personally identifiable visitor information may be shared for marketing, advertising, or other uses.

The Foundation may contract with other parties to market and serve ads on its behalf. The Foundation wishes to communicate in ways beneficial to users. Users can specify contact preferences when providing information. They can also update preferences later by contacting the Foundation. Note that some preferences do not prevent legally required notices or similar communications.

As there are no common industry standards for “do not track” systems, the Foundation’s Website does not respond to Do Not Track signals. Additionally, third parties may collect information about user activity on the Website as described in the “Information Collection and Use” section.

User Consent and Release

By using the Website, users consent to this Privacy Policy and release the Napa Valley Farmworker Foundation, including its officers, directors, employees, agents, representatives, successors, and assigns, from claims, damages, liabilities, and expenses arising from unauthorized access and use of personally identifiable information by unauthorized individuals or third parties unaffiliated with the Foundation.
